Memo

Background.

On May 1, 2017, the Village of Glen Ellyn entered into an agreement with the DuPage County Forest Preserve District to lease two buildings within the Churchill Woods Forest Preserve property shown on the attached map. One of the buildings will be used by the Village for salt storage, and the other building is the McKee House. Both structures require alteration to be useful to the Village and both were located within the corporate limits of the Village of Lombard. In order to avoid having to go through the Village of Lombard for building permits to improve the structures, the Village amended its boundary line agreement with the Village of Lombard on April 9, 2018, so that the subject property could be annexed into the Village (prior to Glen Ellyn being able to provide water and sanitary service to the property). The Village of Lombard then disconnected the property from its jurisdiction on May 17, 2018. Subsequently, the DuPage County Forest Preserve District submitted a petition to the Village dated June 5, 2018 to annex this property and the property to the south, which provides contiguity.

 

Both properties to be annexed are now in Unincorporated DuPage County and are generally located west of I-355 and between St. Charles Road and Crescent Boulevard. If the properties are annexed, they will be automatically zoned RE - Residential Estate District in accordance with section 10-3-3 of the Zoning Code. This is the most restrictive of the residential districts, but staff feels that the property should be zoned CR - Conservation Recreation, since it is Forest Preserve District property. A public hearing will be held before the Plan Commission to rezone the properties if the Village Board approves the annexation.

 

As mentioned, the annexation of these properties would allow the Village more control over any proposed improvements to the leased structures on the northern parcel. In addition, annexation of these properties would give the Village contiguity to several other properties which have annexation agreements, including properties on Crescent Boulevard and Hill Avenue. With the incorporation of the Churchill Woods properties, the Village would expand its boundary to the eastern limits of its planning jurisdiction in the northeastern quadrant of the Village (with the exception of a few parcels which belong to ComEd).

 

Action Requested.

The Village Board is being asked to consider the annexation of two properties within the Churchill Woods Forest Preserve. An Ordinance approving the request has been prepared for the Village Board’s consideration at the June 25, 2018 meeting.

Located South of St. Charles Road and West of I-355 into the Village of Glen Ellyn, IL 60137

 

 

              Whereas, on May 1, 2017, the Village of Glen Ellyn (“Glen Ellyn” or “Village”) and the Forest Preserve District of  DuPage County (“Forest Preserve District”) entered into a 50 year lease agreement to allow Glen Ellyn to use certain buildings within the Churchill Woods Forest Preserve; and

Whereas, the leased buildings are located on property that is legally described as “Parcel 1” on Exhibit “A”, attached hereto and made a part hereof; and

Whereas, “Parcel 1” was within the corporate limits of the Village of Lombard (“Lombard”) prior to the disconnection of the property on May 17, 2018; and

Whereas, Glen Ellyn  and  Lombard entered into a boundary line agreement on March 1, 2012 which was amended on September 14, 2015 to remove “Parcel 1” from Lombard’s planning jurisdiction and to include it in Glen Ellyn’s planning jurisdiction; and

Whereas, the boundary line agreement was further amended on April 9, 2018 to allow Glen Ellyn to annex “Parcel 1” prior to being able to provide utilities to the property; and

Whereas, “Parcel 2”, also legally described on Exhibit “A” is not now within the corporate limits of any municipality but is contiguous to Glen Ellyn; and

Whereas, the Forest Preserve District has filed a written annexation petition with the Village Clerk of the Village of Glen Ellyn, to annex “Parcel 1” and “Parcel 2” pursuant to and in accordance with Section 7-1-8 of the Illinois Municipal Code, 65 ILCS 5/7-1-8, a copy of which is attached hereto as Exhibit “B”; and

Whereas, the properties to be annexed are identified on the Plat of Annexation prepared by Gentile and Associates, a reduced copy of which is attached hereto as Exhibit “C”; and

Whereas, legal notices regarding the intention of the Village to annex the properties have been sent to all persons and public bodies required to receive such notice by State statute; and

              Whereas, all petitions, documents, and other necessary legal requirements are in full compliance with the statutes of the State of Illinois, specifically Chapter 65, Sections 5/7-1-1 and 5/7-1-2 of the Illinois Compiled Statutes; and

              Whereas, it is deemed to be in the best interest of the Village of Glen Ellyn that said property be annexed thereto.

Now, Therefore, Be It Ordained by the President and Board of Trustees of the Village of Glen Ellyn, DuPage County, Illinois, in the exercise of its home rule powers, as follows:

Section One:  The findings of fact set forth herein­above in the recitals are hereby adopted by the President and Board of Trustees of the Village of Glen Ellyn.

Section Two:  Pursuant to Section 7-1-8 of the Illinois Municipal Code, 65 ILCS 5/7-1-8, the subject properties, legally described in Exhibit “A”, and the adjacent rights-of-way are hereby annexed to the Village of Glen Ellyn, DuPage County, Illinois.

Section Three: The Village President and Village Clerk are hereby authorized to execute the Plat of Annexation for the properties, a reduced copy of which is attached hereto as Exhibit “C”.

Section Four: In accordance with Section 10-3-3, the properties shall be automatically zoned RE Residential Estate zoning district upon annexation. The Village of Glen Ellyn Zoning Map shall be and is hereby amended to show the subject properties as incorporated within the Village limits and zoned as RE Residential Estate zoning district.

Section Five: The Village Clerk shall be and is hereby authorized and directed to cause a certified copy of this Ordinance and the Plat of Annexation to be recorded in the Office of the DuPage County Recorder.

Section Six: This Ordinance shall be in full force and effect from and after its passage, approval, and publication in pamphlet form, each in the manner provided by law.
